Terms of Service

1. Acceptance of Terms

These Terms are an agreement between you and ForeFront Labs Pty Ltd (ABN 89 698 420 263) ("ForeFront Labs", "we", "us" or "our"), which operates Magic. By accessing or using the Magic website, applications or services (the "Service"), you agree to these Terms. If you use the Service for a business, you confirm that you have authority to bind that business.

2. Description of Service

Magic is a modular business software platform for beauty and wellness operators. It provides tools for client management, scheduling, billing, documents, communications, automations, analytics, and related workflows. The Service is provided on a subscription basis.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information when creating your account and to update it as needed.

4. Acceptable Use

You agree not to misuse the Service, including attempting unauthorized access, interfering with other users, bypassing security controls, sending unlawful or abusive communications, scraping public endpoints, or using the Service for illegal purposes.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership and control of data you enter, upload, create or collect through the Service ("Customer Data"). You give us a limited, non-exclusive right to host, copy, process, transmit, display and back up Customer Data only as needed to provide, secure and support the Service, carry out your instructions and enabled integrations, and comply with law. We do not sell, rent, broker, trade or separately commercialise Customer Data. This limited right ends when Customer Data is deleted from the Service, subject to reasonable backup, security, legal, tax, billing and dispute-resolution retention.

You are responsible for having the rights, collection notices and consents needed to collect and use information about your clients, team and business through Magic, particularly health or other sensitive information. You must respond appropriately to privacy requests relating to Customer Data you control. We will provide reasonable assistance through available product controls and support.

6. Subscription and Billing

Paid Magic plans are billed on a recurring basis unless otherwise stated. Prices, billing periods and included features are shown when you subscribe. You are responsible for accurate billing details, applicable taxes and fees charged by connected providers. You may cancel according to the controls or notice process provided with your plan. Refunds are handled on a case-by-case basis unless required by law.

7. Connected Payments

Magic lets you connect Stripe to accept booking deposits and service payments from your clients. Those payment services are also subject to the provider's terms. The applicable connection determines settlement, fees, refunds, disputes and chargebacks. Unless a checkout expressly says otherwise, your client's purchase of beauty or wellness services is from your business, not ForeFront Labs, and you are responsible for your services, pricing, refunds and consumer obligations.

8. AI Assistance

When you choose an AI-assisted feature, Magic may send the minimum relevant prompt and context to our configured business/API AI provider to produce the requested result. We do not use Customer Data to train our own general-purpose AI models or opt Customer Data into a provider's general model training. You remain responsible for reviewing outputs and deciding what to send, charge, book, record or otherwise act on. AI assistance is not medical, legal, tax, financial or clinical advice.

9. Availability and Liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we exclude implied warranties and are not liable for indirect, incidental, special or consequential loss arising from use of the Service. Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including under the Australian Consumer Law.

10. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access where reasonably necessary to address non-payment, unlawful use, security risk, material breach or harm to the Service or others. Where practical, we will give notice and a reasonable opportunity to remedy the issue.

11. Changes to Terms

We may update these Terms from time to time. We will update the date above and notify account holders of material changes where appropriate. Continued use after the updated Terms take effect constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You and ForeFront Labs submit to the courts of New South Wales and the courts entitled to hear appeals from them.
